France Commercial Yacht VAT Exemptions Challenged by EU

The challenge has come rather sooner than expected. The European Commission, which jointly with the Court of Justice is the guardian and enforcer of European law, has formally asked France to change its legislation granting VAT exemption for certain transactions involving vessels. The Commission considers that the scope of France’s current VAT exemption goes beyond what is permitted by EU law as contained in the VAT Directive.

“So the immediate impact of trimming the FCE regime may be to re-instate customs controls and deny suppliers of commercial charters in France the right to tax-free fuelling and provisioning that they have enjoyed so far. Those businesses would have to seek the more traditional avenues of inter-EU VAT mitigation, which lie in joining the VAT system as registered persons in a suitable EU territory.”

A day of reckoning has loomed ever since the French legislator introduced a VAT exemption regime that included all yachts in commercial use in May 2004. Article 262-II-2o, 3o, 6o, and 7o and Article 291-II-5o of the French Tax Code, until then applicable only to merchant ships, were extended to assimilate yachts earmarked for commercial charters. That single act, now commonly known as the French Commercial Exemption (FCE), opened a freeway for superyachts into France, a key Member State of Europe’s fiscal club. All that a yacht needs under the regime is to hold a commercial registration certificate from any Flag State; have a permanent crew; and be disposed to charter. Customs entry and exit formalities for such yachts were scrapped. Charter activities that the yachts undertake in France are treated as exempt from VAT. And the yachts enjoy tax-free fuelling and provisioning on top of all that.

The French regime however contrasts sharply with those in other EU Member States, which have no such exemptions in law. The regime has been a boost to the yachting industry in recent years. Among other things, it has pushed the concentration of large yachts in France to an all time high. It has even influenced other EU countries, such as Italy and Malta, who tolerate some features of the regime, albeit without specifically changing their national law. That makes the Commission’s attack on the French regime truly momentous and significant. To the more conservative EU Member States looking on the FCE, France had literally taken a wrecking ball to the EU fiscal fence – a bold demolition job. Reckoning that it has broken ranks technically, France is now being asked by the Commission to step back into line and put the fiscal fence back up at her end of the EU. There may also be an implied warning to France’s admirers to be less dazzled.

Trimming Sharply

The Commission’s charge against France is that it has unduly extended eligibility for VAT exemption to all vessels used for commercial activities, while it should be limited only to vessels used for navigation on the high seas. The ‘on the high seas’ qualification is central, for two reasons. Firstly, it falls within the contextual setting of Article 148 of the VAT Directive, which is entitled ‘Exemptions related to International Transport’. The Commission maintains that the scheme and purpose of that article means that qualification applies to all the sea-going vessels mentioned in the said provision, but only if their activities take place on the high seas. Secondly, exemptions themselves are independent concepts of EU VAT law that must be interpreted strictly, since they constitute exceptions to the general principle whereby any supply of goods or services supplied for consideration by a taxable person is subject to VAT. The transactions concerned in this article are exempted because they are treated as ‘exports’. Therefore when transposing that Directive into national law, no Member States should exercise the discretion they have by linking the exemption to any additional requirements, particularly if, like the FCE three-condition rule, they unduly compromise the object of the law. By not stipulating use for navigation on the high seas as a condition for the exemption, says the Commission, the current French national law fails on both counts. It allows a wider scope of vessels and their activities to be covered by the VAT exemption.

France on its part is entitled to reason that all it had done by way of the FCE was to implement the exemptions envisaged by the VAT Directive through objective criteria specific to the modern economic activity of commercial yachting. When the VAT exemptions were first drawn up in the 1970s, commercial yachting was almost non-existent; but in more recent times, it has clearly emerged as a major sector of activity in France and elsewhere. The law should thus be interpreted to reflect and recognise this modern trend. Although the French domestic legislation does not fully reflect the wording of the VAT Directive, it is framed to provide certainty to taxpayers in a pragmatic way concerning which category and supplies of vessels can qualify for exemption.

However, as the UK and Danish experience in similar circumstances a year ago over the VAT exemption of aircraft shows, such a defence is not viable enough to satisfy the Commission. Indeed, as at end March 2010, the Commission had already rejected France’s defence and given it two months to amend its legislation. Judging by the current buzz of activity in the Tax Legislation Division of the Douane in Paris, France is now labouring to comply with the Commission’s request.

What France actually delivers from that labour beyond correcting the offending articles of its Tax Code remains to be seen. It is hoped that the authorities will engage and consult with the yachting industry in the same way that they did in the lead up to the favourable rule changes in 2004. But the tight deadlines imposed by the Commission mean that such an approach cannot be guaranteed. Given that the VAT Directive’s provisions are based on the use to which a vessel is put and the location of such use, stipulating use for navigation on the high seas as a condition for exemption under FCE would require that chartering takes place in international waters outside the EU. That would be the very antithesis of conventional yachting, whose pleasure and recreational purpose will sooner yield to the adhesive appeal of the inshore waters and coasts of the EU.

On the other hand, requiring foreign owners and operators of yachts within French territorial waters to now register and account for VAT in France would be too fundamental a step that France may not be ready to take right away, more so because Member States have been allowed a flexible timetable until 1 January 2015 to complete the implementation of the game-changing place-of supply VAT rules for inter-EU supplies of services.

In the heart of the Whitsundays is Hamilton Island, a yacht charter destination more on the ‘civilized’ side. Hamilton has a great marina, a jet airport, a couple of high-rise buildings (which fit in very well with the landscape) and a bustling scene of restaurants and bars. Hamilton Island is the largest development on the Islands of Australia and you can fly in and pick up a yacht charter directly from this base.

The Whitsunday yacht charter season runs all year, although the Whitsunday’s are prone to cyclones and tropical rain during summer, from November to March. These are also the warmest and most humid months. The climate is warm all year, with the temperature rarely falling below the twenties in winter. Luxury Motor yacht SILENT WORLD II was built in 1991 by Christensen Yachts and has gone through a major refit in 2007. She can accommodate 8 guests in 3-4 cabins and has 6 permanent crew.

Silent World II’s major refit which was completed in July 2007 included a new open aft deck. Additionally, there is a new flat screen style wheelhouse to give the boat a more modern look. One of the Twin Cabins now has the ability to convert to a double making it ideal for either couples or families. All of the soft goods including the carpet, upholstery, blinds and linens have been replaced.

SILENT WORLD II is a classic yacht that has been updated with unrivaled comfort and style. There are 3 decks to enjoy. The lower aft is perfect for enjoying cocktails or a meal in the shade, the sun deck above is also a great spot for alternative al fresco dining on the large free standing teak dining table, new teak decking and removable South Beach top for shade Just aft of this is the perfect sunning area in the teak lounge chairs. The best view is from the Jacuzzi deck, which as iPod fittings so you can listen to your favorite music. On this deck an additional sun pad, and bench seating has been added. The steps into the hot tub are semi-circular with a stainless handrail on each side.

The interior of SILENT WORLD II is stylish yet relaxed. The formal dining room has room for 8 guests and the cuisine will be tailored to your specifications. The main salon provides a perfect movie venue after dinner with comfortable chairs and a 50” plasma TV.

SILENT WORLD II has an excellent range of water sport toys and her crew of six who are fun and enthusiastic and look forward to welcoming you onboard.

Luxury Motor yacht PRINCESS ILUKA (ex Iluka) is 34,50m (113′ 2″) in length. The yacht was originally constructed by Ray Kemp in Tasmania in 1979 however Princess Iluka has undergone an extensive refit and rebuild over a period of three years. She can accommodate up to 8 guests in 3 double and 1 twin cabin.

The timber used in PRINCESS ILUKA’s construction included Tasmanian oak and Huon pine. The timbers were logged and milled around 1964 in the Gordon River region in the south west wilderness of Tasmania. This area is renowned for its unique huon pines, which was the most sought after boat building material, mainly due to its resistance to rot and borers. The huon pine used for Iluka’s hull was over 750 years old and once harvested, was left to cure for two years before building could commence. The timber which forms the keel is one continuous piece of spotted gum which took three weeks to extract from the forest. A construction of this type would not be possible today as the timber is now a protected.

Princess Iluka has a classic clipper bow which forms the foundation of the vessel. PRINCESS ILUKA’s refit was undertaken in Australia and took 3 years to complete and her hull timbers were stripped bare to make way for her transformation. The superstructure was remodelled and rebuilt and her hull was lengthened to include a new transom. The interior transformation included the latest technology in engineering, electrical and plumbing systems, as well as state of the art electronics. The super yachts owners have been sympathetic to the yacht’s heritage and history and there is a distinctly Australian flavour throughout the interior.

Motor yacht PRINCESS ILUKA can accommodate up to a total of 8 guests in 3 double and 1 twin cabin. The full width master cabin is located on the main deck and features a king size bed, sitting area, desk, wardrobe and bathroom with bath and stall shower. The remaining cabins are located on the lower deck and include a double cabin aft, a double and a twin cabin forward, all with ensuite facilities.

PRINCESS ILUKA is based in the stunning Whitsunday Islands on the Great Barrier Reef of Australia, in the winter from April to October. The Whitsunday’s are protected from the ocean by the Great Barrier Reef, and offer some of the most sheltered waterways in the South Pacific for cruising and the surrounding area includes around 74 islands. She relocates to Sydney, Australia during the summer months.

ILUKA is an aboriginal word meaning “by the sea”.

She was designed by Greg Marshall Design and built by McMullen & Wing in Auckland, New Zealand, where she is scheduled to be launched next week. The luxury Explorer yacht will be available for South Pacific luxury yacht charters as well as location further afield.

Powerfully styled, the expedition motor yacht MY BIG FISH is a mariner’s yacht – a modern blue water exploration superyacht, in both design and build.

The philosophy behind the creation of Big Fish concerns the concept that the ideal luxury expedition yacht should be capable of achieving certain key requirements. Superyacht Loaloat Al Behar Newly Available for Mediterranean Yacht Charters

Luxury yacht ‘Loaloat Al Behar’ is an unusual and interesting motor yacht. With a length of 104m, and a beam of 16.2m, she is one of the longest and largest luxury charter yachts available anywhere in the world.

The 104 metre motor yacht ‘Loaloat Al Behar’ is now available for luxury yacht charters in the Mediterranean at a charter rate of €250,000, plus expenses.

Yacht ‘Loaloat Al Behar’ was originally built in 1982 for royalty (the Sultan of Oman) at the Italian shipyard Picchiotti. Picchiotti – currently part of the Perini Navi Group – was responsible for the luxury yacht’s exterior design and engineering, while her interiors were styled by Oman Rys.

Then in 1989 Devonport Yachts refitted the superyacht and again last year in 2009 she enjoyed a refit in Dubai. This latest refit was extensive and yacht ‘Loaloat Al Behar’ received a newly painted hull and exterior as well as a carefully modernised interior.

Luxury CNB sailing yacht SPIIP to charter in Egypt and the Red Sea

Sailing yacht SPIIP is a CNB 86, designed by the naval architect Philippe Briand. This luxury super yacht measuring 26,21m (86′) exudes performance, luxury and opulence and will be in Egypt (Hurgadha) from January to April 2010.

The archipelago around the Hurghada area has some of the best diving and snorkelling in the world. This unique charter destination is totally isolated with the exception of a few dive boats and fisherman. Amongst the atolls you have the feeling  of being anchored in the middle of the sea and yet you are totally protected. All though the area is renowned for being windy at times, due to the numerous reefs you are able to sail in sheltered waters.
Please see below for a sample itinerary in this amazing untouched destination.

Day 1 – You are welcomed aboard sailing yacht SPIIP at El Gouna. After a welcome drink,  explore local markets at Hurghada and sample the refreshing sugar cane juice – or explore the El Gouna resort area and treat yourself to a health spa or game of golf in the middle of the desert.

Day 2 – Set sail for Shab el Erg about 2 hours away. Shab el Erg is an atoll with great anchoring inside and crystal clear water. There is an idyllic pinnacle which you can snorkel with lots of lion fish and sometimes dolphins.

Day 3 – Set sail to Bluff point (3 hr sail). This spectacular anchorage has a beautiful  beach and a fantastic wall dive or snorkel, abundant with fish, turtles and a resident napoleon fish.

Day 4 – Shab umm Usk (1 hr sail ) is another atoll that you can enter with a variety of snorkels depending on the wind. It is however best known for its group of resident dolphins that often come for a play. For dinner it is possible to select a fresh fish or lobster from the local fisherman. 
 
Day 5 – For those who like water sports, Endeavour Island is your spot  which is a 1 hr  sail away. This very protected anchorage is great for water sports and some beach combing.

Day 6 and 7 – Depending on the weather it is possible to visit the national park of the Giftun Islands ( 3 hrs ) or Shab Ali (2 hrs ) in the straits of Gubal. If the weather is too windy which happens sometimes we can organise a trip to Luxor to see the Karnak temple and the valley of the Kings and Queens. If you wish to dive some of the numerous wreck dives it is no problem to rendezvous with a dive boat. It is also possible to incorporate the week with a PADI diving course, organised with a Swedish diving company called Colona dive situated at the marina of El Gouna.

63rd Cannes Film Festival 12-23 May 2010.

Cannes Harbour Palais

The 63rd Cannes Film Festival will take place in Cannes, France from 12-23 May 2010.

This yearly event in Cannes demands the attention of the Entertainment World, as the movie industry congregates on the French Riviera to watch films, secure deals, socialize and award the best films and achievements of the past year.

The formal program takes place in the “Palais des Festivals” – which is the main convention center in Cannes with several theaters that will show movies nearly non-stop for 10 days. The Palais is directly next to the Old Port of Cannes.

American film director Tim Burton will be the President of the Cannes film festival Jury this year in what he said “is a dream come true”. The visionary screen story teller’s early film “Ed Wood” was shown at Cannes in 1995.

“The competition” is the festival’s main event and this is where you’ll find all the glamour and glory. Films in this section are referred to as being ‘in competition’ and compete for a variety of awards. The Holy Grail is of course the Palme d’Or (Golden Palm) for best picture, which is one of the most prestigious awards a film can receive anywhere.

Chartering a super yacht, motor yacht boat or sailing yacht is a very effective way for a variety of companies and individuals to attract and entertain clients during the festival. Yachts can be “branded” with your company name allowing you to present a high profile during an event with close association to class and the elegance of Super Yachts. Yachts wanting to berth in the old port of Cannes next to the Palais des Festivals during an event must submit a berth application to the port of Cannes well in advance of the event. Chartering at the Cannes film festival however is not limited to large superyachts with confirmed berths in the port. It is also possible to charter a yacht in neighbouring ports or at anchor to use as accommodation, parties or meetings.

Luxury Motor yacht OCEAN PEARL unveiled.

YachtPlus have unveiled their new 41m (134ft) Lord Foster + Partners designed super yacht called OCEAN PEARL in Carrara, Italy.  The Foster design was teamed with the technological skill of Rodriquez Cantieri Navali and will undergo official sea trials prior to its official launch in April.  Motor yacht OCEAN PEARL is the 2nd yacht to be launched out of the fleet of 4 planned.

Superyacht Ocean Pearl

Yacht Plus is a Fractional ownership company who design and build these beautiful yachts then sell fractional ownership to a maximum of 8 owners per yacht. The owners can choose to use the yacht privately or offer the yacht for charter during their share of the calendar year. The first motor yacht in the fleet called  OCEAN_EMERALD is available for charter throughout the Mediterranean and OCEAN PEARL will also be available for luxury yacht charters this summer in Italy.

The third yacht of the fleet, OCEAN SAPPHIRE is due to be launched in May 2010 and the fourth, yet to be named, is scheduled to enter service at the beginning of 2011.
